By booking a workshop or photo tour you agree to abide by the terms and conditions set out below.
The company is Setoro Limited, trading as Fototonic. Fototonic is a business name owned by Setoro Limited. Both the company and the business name are registered with the Registrar of Companies at the Jersey Financial Services Commission. For the purposes of these Terms and Conditions, we will describe ourselves as Fototonic.
1.1 A non-refundable deposit of the amount stated in each photo tour description is required at the time of booking.
1.2 The balance of the tour price is due 8 weeks prior to the departure date. Should this final payment fail to reach us by the date specified, we reserve the right to treat the booking as cancelled and retain the deposit. If a booking is made within 8 weeks of the departure date then the full amount is payable at the time of booking.
1.3 Any cancellation of a photo tour made by the client must be made in writing and will incur a cancellation charge equal to the deposit paid at the time of booking when made more than 8 weeks prior to the event date. Cancellations made within 8 weeks of the event date will incur a cancellation fee equal to 100% of the cost of the photography workshop or tour.
1.4 The receipt of a deposit does not imply acceptance of a booking. We will confirm our acceptance of your booking in writing and it is at the time we send out this confirmation that a contract comes into existence between us.
1.5 For workshops that include a hotel stay, we will confirm that a workshop is running eight weeks before the start date of the workshop and it will be at that time that you will receive an invoice for the balance.
1.6 You are advised not to confirm any personal travel arrangements (flights or ferry bookings) until we confirm to you that the workshop or tour will definitely take place. Very occasionally workshops do not meet the minimum number of participants to become viable and we reserve the right to cancel under-booked workshops and refund the deposit to those people who have booked. If this happens, you may be offered a choice of alternative workshop/tour dates.
2.1 Full payment of the workshop or course fee is payable on booking, unless otherwise agreed with Fototonic
2.2 Any cancellation of a photo workshop or course made by the client must be made in writing and will incur a cancellation charge of £25 when made more than 4 weeks prior to the event date. Cancellations made within 4 weeks of the event date will incur a cancellation fee equal to 100% of the workshop or course fee.
3.1 Fototonic reserves the right to alter or cancel any workshop, course or photo tour. Should a substantial alteration or cancellation become necessary, you will then have the choice of accepting the change, taking an alternative workshop, course or photo tour (and where this is of a lower price we will refund the difference), or withdrawing from the contract and accepting a refund of all monies paid to Fototonic. A substantial alteration excludes changes to departure airports or ferry ports where other alternatives have been offered.
3.2 In the event of the specified tutor being unable to attend due to illness or other circumstances beyond our control, we will make every effort to provide another tour leader, reschedule or compensate the workshop participants. In the event a cancellation of the full workshop we will refund your deposit and full balance or offer you alternative dates. The decision will be yours as to which you would prefer. Compensation for curtailment or Fototonic cancelling part of the workshop will be based on a percentage of the full fee calculated by the extent of the cancellation or curtailment. For example if one day of a two day workshop has to be cancelled due to illness, we will refund at least 50% of the fee or offer an alternative date.
3.3 In the unlikely event that we become unable to provide a significant proportion of the services you have booked after you depart, we will make alternative arrangements for you at no extra charge.
3.4 If you have special dietary or other requests, you should inform us of these prior to departure. We will advise the relevant supplier of your requirements but we cannot guarantee that such requests will be met and will have no liability to you if such requests are not met.
3.5 The type of photo tours and workshops we offer requires flexibility and must allow for alternatives. For this reason the outline itinerary and description of the photo tour or workshop must be taken as an indication of what may take place on the tour or workshop, and not as a contractual obligation on our part.
4.1 Where airport/hotel transfers are included in the cost of the photographic weekend or tour, such transfers are only guaranteed when participants travel on flights agreed by us. We will always seek to accommodate participants arriving or departing on different flights, however, when this is impractical, participants will be responsible for their own transfer costs and arrangements.
4.2 Bookings can only be made by those of 18 years of age. Bookings for minors can be made by a parent or guardian provided that the minor is accompanied by the parent or guardian who accepts full responsibility for the minor in every way.
4.3 We will do all that we can to ensure safety of individual participants. However, anyone not heeding our advice with regard to tides, terrain or weather conditions does so at his or her own risk.
4.4 For one-day and half-day photography workshops, the workshop fee does not include your transport to and from the meeting place, car parking, insurance, or photographic equipment/materials.
4.5 Unless specifically mentioned in the workshop description, the client is responsible for his or her own travel, motor expenses, refreshment and meal expenses. For one-day and half-day workshops, car sharing is encouraged with those sharing a car encouraged to share petrol costs.
4.6 If we offer to loan camera equipment or camera accessories to a client during a workshop, that person then becomes fully responsible for the safety of such equipment. If any damage or loss occurs, the client agrees to replace the item with a new replacement at full cost.
4.7 A reasonable level of fitness and appropriate equipment will be required for all photography workshops / tours.
5.1 Fototonic does not accept liability for any loss or additional expenses, caused by delay or interruption to travel services through weather conditions, civil disturbance, industrial action, strikes, wars, floods or sickness. Such losses or additional expenses are the responsibility of the participant.
5.2 Fototonic does not accept responsibility or liability for death, bodily injury or illness caused to the client or any other person included on the booking form unless arising from the negligent act of our employees (whilst acting in the course of their employment).
5.3 The client must communicate any perceived failure in the performance of this contract on the spot to the tour leader thus giving the tour leader the opportunity to achieve a satisfactory solution. Should this not be possible, you should make your complaint known to us in writing within 28 days of the completion of the workshop or photo tour.
6.1 Fototonic provides no travel insurance cover. We therefore strongly advise obtaining the appropriate travel insurance cover before you set out on the photo tour or workshop (whether in the Channel Islands, the United Kingdom, or any other country or territory).
6.2 It is a condition of your booking that you have travel insurance to cover holiday cancellation, personal accident or injury, medical and repatriation costs, loss of baggage, personal money and belongings plus flight cancellations and delays and also insurance that covers you for any loss or damage of camera gear. By making your booking you hereby confirm that you have appropriate insurance.
7.1 For overseas travel, all clients must be in possession of a valid passport and all visas, permits and certificates, including medical certificates required for the whole of the journey and the client accepts responsibility for obtaining the same. All information and advice given by us on visas, vaccinations, climate, clothing, baggage, special equipment, etcetera, is given in good faith.
By paying the full fee in respect of a photographic workshop, course or tour, or by paying a deposit or by clicking acceptance of these terms and conditions on the website, you are agreeing to accept all the above terms and conditions. The person who makes the payment and/or completes the booking form on the website does so on behalf of all the individuals included in the booking, so that all are bound by the booking conditions.
